In order to implement the requirements of the Municipal Party Committee and the Municipal Government on the prevention and control of the epidemic situation, to ensure that sick employees receive treatment at ease, to protect the legitimate rights and interests of quarantined personnel and those who have not returned to Beijing in time due to the epidemic situation, to ensure the normal production and operation of enterprises, and to maintain stable labor relations, The relevant issues are notified as follows:
I. Enterprises shall guarantee sick employees to enjoy medical treatment period and sick leave pay in accordance with law
According to the relevant laws and regulations of the state and this Municipality, employees who have stopped working for medical treatment due to illness should enjoy a medical treatment period. During the period of medical treatment for employees, the enterprise shall pay sick leave pay in accordance with the labor contract or collective contract. The sick leave pay shall not be less than 80% of the minimum wage in Beijing.
2. Enterprises should properly arrange those who have been quarantined due to the epidemic situation and those who have not returned to Beijing in time to return to work.
For suspected patients with new-type coronavirus-infected pneumonia, and those who are in close contact with patients with new-type coronavirus-infected pneumonia, suspected patients are quarantined and isolated by medical observation as patients or carriers of pathogens. The wages during the quarantine and medical observation shall be paid by the affiliated enterprise as normal Pay during work.
For employees who did not return to Beijing to return to work due to the epidemic situation, the enterprise may give priority to arranging annual leave for employees. Among them, employees who have worked cumulatively for one year and less than ten years are entitled to five days of annual leave; for those who have worked for ten years and less than twenty years, they have been on vacation for ten days a year; Employees enjoy the same salary during their annual leave as during normal work. If the employee has not returned to work for a long period of time, the enterprise may arrange for the employee to stay on duty after consultation with the employee. During the period of stay, the enterprise shall pay the basic living expenses according to not less than 70% of the city's minimum wage. Employees on business trips who perform work tasks and fail to return to Beijing due to the epidemic situation shall be paid by the affiliated enterprises according to the wages during the normal work period.
3. Enterprises can adopt centralized work and centralized rest to maintain normal production and operation.
Enterprises affected by the epidemic situation may apply to the human resources and social security department for the implementation of a comprehensive calculation of the working hours system, and implement rotation and rest according to the needs of production and operation.
4. The human resources and social security departments in all districts must effectively do a good job of service guidance and monitoring and disposal.
All districts should implement territorial responsibilities, strengthen guidance on labor employment for enterprises affected by the epidemic, increase the prediction and early warning of labor relationship risks, and effectively protect the legitimate rights and interests of employees. It is necessary to open up green channels and do a good job of administrative permits for the special working hours system of enterprises in accordance with the law. In accordance with the requirements of the epidemic prevention and control work, strengthen the employment monitoring of enterprises with a high mobility of personnel such as labor dispatch and effectively prevent and handle emergencies.
